ARTICLE 2 APPLICATION OF THE CONDITIONS DESCRIBED IN THIS DOCUMENT
These general terms and conditions of sale govern the contractual relationship between CHATEAU DE JASSON and its customer, both parties accepting them without reservation. This is a contract for the sale of products as part of a distance sale on the CHATEAU DE JASSON website. These general terms and conditions are fully accepted by the customer and apply to any order placed on the site and prevail over all other terms and conditions of sale.
ARTICLE 3 - DATA PROTECTION ACT
In accordance with Law No. 78-17 of January 6, 1978, the processing of this personal information has been declared to the National Commission for Information Technology and Civil Liberties (CNIL). The consumer has the right to access and rectify this information at any time, which he can exercise with CHATEAU DE JASSON.
The information collected for the purposes of distance selling is mandatory, as this information is essential for processing and delivering orders and for issuing invoices. The customer consents to the use of the personal data collected under this order for the CHATEAU DE JASSON customer database.
ARTICLE 4 - APPLICABLE LAW
This contract is subject to French law, to the regulations on distance selling (articles L 121-16 to L121-20 of the consumer code) incorporating directive 97/7 EC of May 20, 1997 relating to the protection of consumers in matters of distance contracts.
ARTICLE 5 - ACCEPTANCE OF ORDER
The buyer will receive an email detailing the details of their order.
ARTICLE 6 – VALIDITY
The offers presented on the site are valid while they are online.
ARTICLE 7 - GENERAL OBLIGATION OF THE PARTIES
Obligations of CHATEAU DE JASSON:
CHATEAU DE JASSON undertakes, after confirmation of the order and validation of payment, to deliver the ordered products to the recipient by carrier.
CHATEAU DE JASSON reserves the right not to register an order in the event of force majeure and undertakes to notify the customer.
Customer Obligations:
By placing an order, you agree to take delivery of the products and pay the price, as well as the transport costs and any customs duties, value added tax or other taxes related to the importation of the products into the country of delivery and, more generally, to comply with these general conditions of sale and the laws applicable to you in your country of domicile or, if it is another country, the one in which delivery is to take place.
The customer is responsible for the conservation and use of the products from the time of their delivery.
The customer may not under any circumstances resell all or part of these products.
Any order placed by a customer is exclusively intended for his personal consumption or for the personal consumption of the person in whose name the delivery is to be made.
In the latter case, the customer guarantees the personal acceptance of these general conditions by the recipient of the package. LE CHATEAU DE JASSON undertakes to inform the recipient of the expected delivery. You will be liable for any damage that LE CHATEAU DE JASSON may suffer, directly or indirectly, due to the failure by you or the person taking delivery of the products to comply with the obligations imposed on you under these general conditions of sale.
ARTICLE 8 – PRICE
CHATEAU DE JASSON reserves the right to modify the prices indicated in the event of exceptional events beyond its control. The prices indicated on the website are in Euros, VAT included.
ARTICLE 9 – PAYMENT
Payment for orders is made before delivery. Payments are made online on the website by:
- bank card (Carte Bleue, Visa, Eurocard, Mastercard) securely through the SMC secure EFT. According to the technical characteristics of both the SSL space and the SMC encryption software, the information provided by the buyer cannot be intercepted by a third party. The information entered about the customer is encrypted and will not circulate unencrypted on the Internet. The order will only be validated by LE CHATEAU DE JASSON when the SMC banking server has authorized the transaction
- French check. The order will then be validated after receipt and cashing of the check. Checks must be made payable to SCEA Château de Jasson.
ARTICLE 10 – AVAILABILITY
All orders will be fulfilled while stocks last. If products are unavailable after you place your order, we will notify you by email within 48 hours (on business days).
You can then request the cancellation of your order or the exchange of the product(s) concerned.
ARTICLE 11 - EXECUTION OF THE ORDER
CHATEAU DE JASSON will only deliver the ordered products once the customer's bank has given its approval for payment.
Article 12 – DELIVERY
Delivery will be made to the address indicated by the customer. In case of absence, a notice will be given. LE CHATEAU DE JASSON cannot be held responsible for any possible damage to the products due to the late receipt of a package due to the absence of the customer or the person authorized to receive it.
A contribution to the delivery costs is added to the customer's basket.
Deliveries are made by carrier.
Article 13 – COMPLAINTS
The delivered products have been subject to rigorous care in order to preserve the perfect conservation of the products.
In the event of damage, you must urgently make any reservations in writing and no later than 24 hours. Explanations must be precise and detailed. In the event of missing goods in the package, the customer must also notify LE CHATEAU DE JASSON within 24 hours of receiving the package. After verification and investigation by its services, LE CHATEAU DE JASSON undertakes to return the missing goods.
You can then request the cancellation of your order or the exchange of the product(s) concerned.
Article 14 - GUARANTEES
CHATEAU DE JASSON guarantees that the products delivered comply with current legislation.
CHATEAU DE JASSON will refund the product(s) in the event of a quality defect. In this case, the customer must return the package immediately (within 24/48 hours) for inspection.
CHATEAU DE JASSON cannot guarantee that the products will meet the customer's personal taste expectations. Products should be stored in a cool, dry place.
Article 15 – WITHDRAWAL
In accordance with the provisions of Article 121-20 of the Consumer Code, the customer has, from delivery, a period of 7 clear days to return the package in its original packaging, unopened, with the seals intact and in perfect condition, for the purposes of exchange or refund, the return costs being borne by the customer.
Article 16 - DISPUTE SETTLEMENT
Complaints will be processed within eight days of receipt.
